2. Use of Services

SENDMailer provides email campaign management services, including campaign creation, scheduling, analytics, and a credit-based system for sending emails. You agree to:

• Use the Service for lawful purposes only.
• Not send spam, unsolicited emails, or content that violates applicable laws or regulations.
• Not use the Service to distribute harmful, offensive, or illegal content.
• Comply with all anti-spam laws, such as the CAN-SPAM Act, and ensure recipients have opted in to receive your emails.

3. Account Registration

To use the Service, you must create an account. You agree to:

• Provide accurate and complete information during registration.
• Keep your account credentials secure and not share them with others.
• Notify us immediately of any unauthorized access to your account.

We reserve the right to suspend or terminate accounts that violate these Terms.

4. Payment and Credits

SENDMailer operates on a credit-based system. You can purchase credits to send emails, with pricing as outlined on our Pricing page. You agree that:

• All payments for credits are non-refundable unless specified in our Refund Policy.
• You are responsible for maintaining sufficient credits to send emails.
• We may change credit pricing at any time, with notice provided via email or on our website.

5. Intellectual Property

All content, trademarks, and intellectual property on the SENDMailer platform, including software, design, and templates, are owned by Briteinno or its licensors. You may not:

• Copy, modify, or distribute our intellectual property without prior written consent.
• Use our trademarks or logos without permission.

You retain ownership of the content you upload to SENDMailer, but you grant us a non-exclusive, worldwide license to use, store, and process your content to provide the Service.

6. Termination

We reserve the right to suspend or terminate your account at our discretion, with or without notice, if you violate these Terms or engage in prohibited activities, such as:

• Sending spam or illegal content.
• Attempting to hack or disrupt the Service.
• Failing to pay for credits or violating payment terms.

You may terminate your account at any time by contacting us at support@sendmailer.xyz. Upon termination, unused credits are non-refundable.

7. Limitation of Liability

To the maximum extent permitted by law, SENDMailer and Briteinno shall not be liable for any indirect, incidental, or consequential damages, including but not limited to:

• Loss of profits, data, or revenue.
• Business interruptions.
• Damage to reputation.

Our total liability to you for any claim arising from the use of the Service shall not exceed the amount you paid for credits in the preceding 12 months.

8. Indemnification

You agree to indemnify and hold harmless SENDMailer, Briteinno, its affiliates, and employees from any claims, damages, or liabilities arising from your use of the Service, including but not limited to:

• Violations of anti-spam laws.
• Infringement of third-party rights.
• Content you send via the Service.

9. Governing Law and Dispute Resolution

These Terms shall be governed by the laws of India. Any disputes arising from these Terms or your use of the Service shall be resolved through arbitration in Mumbai, India, in accordance with the Arbitration and Conciliation Act, 1996. You agree to waive your right to a jury trial or class action lawsuit.

10. Changes to Terms

We may update these Terms from time to time. Changes will be posted on this page, and we will notify you via email or on the Service. Your continued use of the Service after changes are posted constitutes your acceptance of the updated Terms.
